ANJ Mandates Revision of Online Gambling Terms in France

Autorité Nationale des Jeux (ANJ), France’s gambling authority, has issued a directive for online gambling operators to thoroughly revise their customer terms and conditions. This decision comes on the heels of numerous player complaints, highlighting the need for clearer, fairer, and legally compliant contractual terms within the online gambling sector.

Ensuring Fair Play and Legal Compliance

The ANJ’s review revealed that several online operators had terms and conditions that contained illegal or unclear clauses, particularly those that unduly limited the operators’ liability or curtailed customers’ rights to compensation. In response, the regulator has called for the elimination of such clauses, emphasizing the importance of transparency and fairness in operator-customer relations.

Operators are specifically cautioned against creating terms that infringe on a customer’s right to legal recourse, including the imposition of restrictions on the jurisdiction for legal disputes.

Moreover, the ANJ is taking a firm stance against terms that limit the types of evidence customers can present, shorten the timeframe for claims, or unjustly reduce compensation amounts.

The regulator is also intensifying its efforts to combat illegal gambling activities, particularly those that exploit the branding of licensed operators to deceive consumers.

In a recent crackdown, the ANJ collaborated with Facebook to identify and suspend numerous accounts associated with illegal gambling, showcasing the regulator’s commitment to maintaining a secure and lawful gambling environment in France.
