BlueBet Hit with $50,000 Fine for Gambling Ad Violations in Victoria

Victorian Gambling and Casino Control Commission (VGCCC) in Australia imposed a significant A$50,000 fine on the gambling operator BlueBet for breaches related to gambling advertising.

The fine stems from unauthorized advertisements displayed prominently along public roadways, an action found in violation of the Gambling Regulation Act 2003.

Investigation and Charges

The VGCCC’s investigation into BlueBet was sparked by a public complaint, leading to charges being filed against the operator in August 2023.

The case concluded with BlueBet found guilty on 43 counts of displaying gambling advertisements on or above public roads during a two-week period in late 2022 at various locations across Victoria.

Specific Locations of Breaches

The illegal advertisements were located at strategic freeway overpasses. These locations included:

  • Princes Freeway on the Point Cook Road Overpass (Laverton)
  • Princes Freeway on the Princes Highway Overpass (Point Cook)
  • Western Freeway Melton – Werribee Road (Rockbank)
  • Western Freeway before Ballarat Road Overpass (Ravenhall)
  • Princes Freeway on Sneydes Road Overpass (Werribee)

Judicial Remarks

Magistrate Greg Thomas expressed skepticism regarding BlueBet’s defense that it was unaware of the legal breach, noting the advertisements’ locations aimed explicitly at males aged 15-54.

While no conviction was recorded, Magistrate Thomas emphasized the “high degree of negligence” on BlueBet’s part and mentioned that a heavier fine and a conviction would have been likely if not for the operator’s guilty plea and cooperation.

VGCCC CEO Annette Kimmitt AM reiterated the importance of keeping gambling advertisements away from public roads, highlighting their visibility to children and vulnerable groups. “This decision sends a clear message to wagering providers that flout these protections for our community,” Kimmitt stated.
