Spanish Supreme Court Overturns Stringent Gambling Ad Restrictions

In a landmark ruling, the Spanish Supreme Court has overturned several gambling advertisement restrictions that were previously established by Royal Decree 958/2020, altering the advertising landscape for the iGaming industry in Spain.

This decision comes after a strong legal challenge from the Spanish Digital Gaming Association, who argued the legality of such constraints.

The initial restrictions, which limited gambling ads on television, radio, and YouTube to the early morning hours between 1am and 5am, and further constricted promotional activities and the utilization of public figures, have been deemed overly restrictive by the Supreme Court.

The court’s ruling acknowledges that “advertising is part of the freedom of business and is subject to limits. However, such limits and prohibitions, insofar as they also affect the exercise of a lawful business activity, must have sufficient legal coverage, without being able to be regulated by independent regulatory standards unrelated to the criteria and limits set by the legislator.”

The implication of this decision allows operators more leeway in targeting ads toward potential new customers, advertising in establishments that facilitate lottery sales, and employing celebrities in their advertising campaigns. Furthermore, the use of video-sharing platforms for advertising purposes has been given the green light.
